Régie du logement: 35 years of an outdated method that gives a bad perception of rental property owners

Monday, January 25, 2016 --- The Association of Quebec Landlords (APQ) can only be offended by the lack of courage of various governments which for the last 35 years have obstinately refused to reform the method of calculation of the Régie du logement.

This year more than at any other time, the tenants’ perception facing rent increases will be distorted.

'' Some building owners who heat with oil or gas will also send notices of rent increase because they will have received large increases in taxes, insurance and for major work done. ''
'' With the announcement of the figures, as the Régie does year after year, tenants rely on a general figure. The figures issued by the Régie are only indicative. These are estimates only and the owner must make his own calculations as each building is different with the unrealistic rates announced each year,'' says Martin Messier.

Let us remind that only the tenants have the right to maintain occupancy and if a tenant refuses an increase, the landlord cannot terminate the lease!

The APQ is convinced that the rent-setting legislation must be reviewed. Pending this reform, which has now become essential according to the APQ, it requires, however, good knowledge about what the law requires from the apartment owners when comes the time to raise the rents.

Indeed, contrary to regular negotiations, owners are required to negotiate differently as we do under the restraint of a law which, once applied by the Régie du logement, comes to disturb our right to negotiate freely.
